A man who raped a drunk woman on the verge of passing out in Brisbane's Queen Street Mall has been sentenced to five months behind bars.
Mohamed Husein Mohamud was interrupted by police after he was caught on the city council's CCTV digitally penetrating the 18-year-old on a bench in August 2015.
The Brisbane District Court heard Mohamud joined the woman when she was drinking at Mick O'Malley's Irish Pub on a Thursday night.
It is believed she had drunk more than 20 standard drinks since 1.30pm and was still drinking at the pub.
Mohamud was told off by a staff member after he was caught with his hand up the woman's skirt while they were sitting in a booth.
The woman was later asked to leave the venue when she was found asleep with her head in Mohamud's lap.
Judge Paul Smith said the woman was so intoxicated she could barely walk and had to be partially carried out of the pub by Mohamud.
The court heard the woman was later seen on CCTV slumped on a bench in Queen Street Mall with Mohamud assaulting her.
When police found the pair the woman was incoherent and falling in and out of consciousness. She was taken away in an ambulance.
Mohamud, now aged 21, pleaded guilty to rape and was sentenced to two years' jail, suspended after serving five months in prison.
"It's a breach of trust by doing this to her, taking advantage of her," Judge Smith said.
